CHANGES IN THE PROCEDURE FOR FILING APPEALS AND CASSATION APPEALS

From October 05, 2021 the subsystems (modules) of the Unified Judicial Information and Telecommunication System (hereinafter - "UJITS") officially became operational. The State Judicial Administration of Ukraine in its letter of October 04, 2021 notified the ministries, central executive bodies, regional state administrations, local courts and courts of appeal, the National Bar Association of Ukraine and territorial offices of the State Judicial Administration of Ukraine thereof.

According to clause 2 of paragraph 2 of section 4 of the Law of Ukraine "On Amendments to the Commercial Procedural Code of Ukraine, Civil Procedural Code of Ukraine, Code of Administrative Procedure of Ukraine and other Legislative Acts" the subsystems (modules) of UJITS shall become operational 30 days after publication by the High Council of Justice of the corresponding announcement.

The High Council of Justice in the Holos Ukrainy newspaper of September 04, 2021 No. 168 (7668) announced that three subsystems (modules) of UJITS became operational, in particular, Electronic Cabinet, Electronic Court, Videoconferencing subsystems.

Thus, the subsystems (modules) of UJITS mentioned in the announcement of the High Council of Justice officially became operational on October 05, 2021.

The High Council of Justice by its decision of August 17, 2021 No. 1845/0/15-21 approved the Regulation on the operation of certain subsystems (modules) of the Unified Judicial Information and Telecommunication System (UJITS).

Following the entry into force of the Regulation on the operation of certain subsystems (modules) of UJITS, the procedure for filing appeals and cassation appeals is changed. Therefore, now the appeal is filed directly to the court of appeal and the cassation appeal is filed directly to the court of cassation.

In addition, appeals and cassation appeals may be filed after registration in the electronic cabinet in the Electronic Court subsystem.

Thus, the operation of UJITS will ensure the efficiency of document flow, which will speed up the terms of consideration of cases and observe one of the fundamental principles of justice - consideration of the case by court within a reasonable time.
